PRIVACY POLICY

TRANSLATION NOTICE
This document is a translation of the original Ukrainian version. In the event of any discrepancy, inconsistency or difference in interpretation, the Ukrainian version shall prevail.
1. General provisions
11.1. This Privacy and Personal Data Processing Policy establishes the procedure for collecting, using, storing, transferring and protecting the personal data of users of the website https://aveniks.com.ua/ (hereinafter referred to as the “Website”).

1.3. This Policy has been developed in accordance with the Constitution of Ukraine, the Law of Ukraine “On Personal Data Protection”, the Law of Ukraine “On Electronic Commerce” and other applicable laws and regulations of Ukraine.
1.4. By using the Website, completing forms, placing orders or otherwise providing their data to the Seller, the user confirms that they have read this Policy.
1.5. When the user does not agree with the terms of this Policy, they must refrain from providing personal data through the Website.
2. Personal data that may be processed
2.1. The Seller may collect and process the following user data:
• first name, last name and patronymic; • phone number; • email address; • city, address, branch number or parcel locker number for delivery; • details of the order recipient; • information about ordered products; • comments and preferences concerning the order; • information required to manufacture a battery according to custom specifications; • company name, EDRPOU code or RNOKPP and other details required for a bank transfer; • history of enquiries, orders, returns and warranty service; • other information voluntarily provided by the user to the Seller. 
2.2. The following technical data may be collected automatically while the Website is being used:
• IP address; • device type, browser and operating system; • date, time and duration of the visit; • pages and products viewed by the user; • source from which the user accessed the Website; • cookies; • technical identifiers and other analytical information. 
2.3. The Seller does not intentionally collect special categories of personal data, including information concerning health, political views, religious beliefs or racial or ethnic origin.
2.4. The user must not provide the Seller with personal data belonging to third parties without an appropriate legal basis or the consent of those persons.
3. Methods of obtaining personal data
3.1. Personal data may be provided to the Seller:
• when an order is placed on the Website; • through contact and feedback forms; • through the custom battery pack order form; • during telephone communication; • by email; • through messaging services; • when arranging delivery, payment, a return or a warranty claim; • automatically while the Website is being used. 
4. Purposes of personal data processing
4.1. Personal data is processed for the purposes of:
• identifying the user; • accepting, confirming and fulfilling orders; • manufacturing products according to custom specifications; • processing payments; • arranging delivery and pickup; • contacting the customer to clarify order details; • providing consultations; • fulfilling warranty obligations; • processing exchanges, returns or repairs; • maintaining accounting, tax and management records; • preventing fraud and unlawful activities; • ensuring the proper operation and security of the Website; • analysing Website traffic and improving the Website; • sending informational and promotional messages when the appropriate user consent has been obtained; • complying with other requirements of Ukrainian law. 
5. Legal grounds for processing
5.1. The Seller processes personal data on the following grounds:
• the user’s consent; • the need to enter into and perform a contract; • taking steps at the user’s request before entering into a contract; • compliance with legal obligations; • protection of the Seller’s legitimate interests, provided that this does not infringe the user’s rights and freedoms. 
5.2. Providing the data required to place and fulfil an order is voluntary. However, without such data, the Seller may be unable to accept the order, process payment or arrange delivery.
6. Processing and storage of personal data
6.1. Personal data may be processed by automated and non-automated means.
6.2. The Seller processes only the data required for the specified purpose.
6.3. Personal data is stored for the period required for:
• fulfilling the order and performing the contract; • providing warranty service; • reviewing possible claims; • complying with tax, accounting and other legal requirements. 
6.4. Once the purpose of processing has been achieved, the data may be deleted, destroyed or anonymised unless further storage is required by law.
6.5. Withdrawal of consent does not affect the lawfulness of processing performed before the withdrawal and does not require the Seller to delete data that must be retained in accordance with the law or for the protection of the Seller’s legitimate rights.
7. Transfer of data to third parties
7.1. The Seller may transfer personal data only to the extent necessary to fulfil an order or ensure the operation of the Website, including to:
• postal and courier service providers; • payment systems and payment service providers; • banks; • Website hosting and maintenance service providers; • order management and customer communication services; • accountants and other authorised contractors; • web analytics and advertising services; • government authorities in cases provided for by law. 
7.2. Such persons receive only the data required to provide the relevant services.
7.3. The Seller does not sell users’ personal data or transfer it to third parties for their own independent use, except as provided for by this Policy or applicable law.
7.4. Certain service providers may process data outside Ukraine. In such cases, the transfer is carried out in accordance with applicable law and the rules of the relevant services.
8. Payment information
8.1. When online payment is enabled, payment data will be processed by the relevant bank, payment system or payment service provider.
8.2. The Seller does not store the full payment card number, its expiry date, the CVV/CVC code or other data processed directly by the payment provider.
8.3. The relationship between the user and the payment provider is also governed by the rules and privacy policy of the relevant provider.
9. Cookies and analytics services
9.1. The Website may use cookies to:
• ensure the proper operation of the Website; • save settings selected by the user; • enable the shopping cart to function; • analyse Website traffic; • assess the effectiveness of advertising campaigns; • improve the structure and content of the Website. 
9.2. The user may restrict or disable cookies in their browser settings. This may affect the operation of certain Website features.
9.3. The Website may use third-party analytics and advertising services. Such services may independently set cookies and process technical information in accordance with their own privacy policies.
10. Informational and promotional messages
10.1. The Seller may send promotional and informational messages only when an appropriate legal basis or the user’s consent exists.
10.2. The user may unsubscribe from such messages by using the unsubscribe link or contacting the Seller using the contact details specified in this Policy.
10.3. Messages concerning a placed order, payment, delivery, warranty or product safety are not considered promotional messages.
11. User rights
11.1. The user has the right to:
• know the sources from which their personal data is collected, where it is stored and the purpose of its processing; • receive information about the conditions under which access to personal data is granted; • access their personal data; • request the correction of inaccurate or outdated data; • object to processing in cases provided for by law; • withdraw consent to the processing of personal data; • request the deletion or destruction of data when it is processed unlawfully or is no longer required; • submit complaints to the Ukrainian Parliament Commissioner for Human Rights or to a court; • use other remedies provided for by law. 
11.2. To exercise their rights, the user may contact the Seller by phone or email using the details specified in this Policy.
11.3. To protect personal data, the Seller may ask the applicant to verify their identity.
12. Protection of personal data
12.1. The Seller takes organisational and technical measures to protect data against:
• unauthorised access; • unlawful use; • accidental loss; • alteration; • destruction; • copying or distribution. 
12.2. Access to personal data is granted only to persons who require it to fulfil their professional or contractual duties.
12.3. The transmission of information over the Internet cannot be completely secure. The Seller takes reasonable security measures but cannot guarantee the complete absence of risks associated with transmitting data over the Internet.
13. Links to third-party resources
13.1. The Website may contain links to third-party websites and services.
13.2. The Seller does not control the data processing practices of third-party resources. Before using such resources, users are advised to review their respective privacy policies.
14. Amendments to the Policy
14.1. The Seller has the right to amend this Policy.
14.2. A new version becomes effective from the moment it is published on the Website unless otherwise specified in that version.
14.3. The current version of the Policy is permanently available on the relevant page of the Website.
